The Formula Grants Program is authorized under the Juvenile Justice and Delinquency Prevention (JJDP) Act of 1974, as amended. The purpose of this program is to support State and local delinquency prevention and intervention efforts and juvenile justice system improvements. Program areas may include: Planning and administration; State Advisory Group allocation; compliance monitoring; juvenile justice issues for American Indian tribes; prevention of substance abuse by juveniles; prevention of serious and violent crimes by juveniles; prevention of juvenile gang involvement and illegal youth gang activities; prevention of delinquent acts and identification of youth at risk of delinquency; and improvement of juvenile justice system operations, policies, and procedures including establishing a system of graduated sanctions, treatment programs, and aftercare.
The Department of Public Safety (DPS) is the designated State agency that administers South Carolina's Title II Formula Block Grant funds. DPS, in collaboration with South Carolina's State Advisory Group, has identified secure juvenile detention as the most pressing problem in the State's juvenile justice system. The issue involves misuse of detention (for minor and status offenses), overuse (excessive lengths of stay due to case backlogs, paperwork, and poor communication), and a lack of a continuum of alternatives that can bridge the gap between secure detention and release to parents/guardians. The State will focus on the following program areas: Jail Removal, Compliance Monitoring, and DMC. As required by the Juvenile Justice and Delinquency Prevention Act of 1974, as amended, the State is required to expend 50% of its Title II formula grants funds to achieve compliance with the Jail Removal core requirement.
